RECHARGE stresses the importance of concluding trilogues on the Batteries Regulation under the Czech Council Presidency

Brussels, 05.07.2022 – At the end of the Czech Presidency of the Council of the EU, it will be two years since the Commission proposed the new Batteries Regulation. While it is key that negotiating teams can discuss openly on the measures of the proposed Regulation, RECHARGE encourages the Presidency to pick up the pace and conclude the Regulation under its six-months term. Developing a competitive and sustainable batteries industry in Europe is urgent: it will contribute to energy security and the strategic resilience of the EU economy – both of which are priorities of the Presidency. 

Tomorrow the Czech Presidency presents its programme to the European Parliament. Following the important progress made during the French Presidency during which the Council reached a general approach, the Czech Republic needs to prioritise this important file in inter-institutional negotiations. The Presidency will now be pivotal in ensuring the trilogue discussions continue and conclude with a compromised reached. We expect that the measures in the final Regulation will deliver on advancing the decarbonisation and energy transition, and that the European batteries value chain becomes a competitive global leader, able to contribute to energy security on the continent and to a resilient EU economy.

The current geopolitical context has demonstrated the vulnerability of our energy system and the crucial necessity for the EU to reduce its dependencies in value chains of strategic interest. Such an approach will be essential to prevent potential future crises from detrimentally impacting key EU industries. “Importantly, existing dependencies in the energy sector should not be replicated in the case of batteries”, stated Claude Chanson, General Manager of RECHARGE.

“We are calling for a swift development and strengthening of the batteries industry on our continent. Against the background of this new context, which highlights the urgency of fostering industrial resilience, the EU must decrease its high dependency on imported batteries. Europe accounts only for a small share of around 7% of the global battery production today, while China takes the lion’s share”, added Chanson. When moving away from oil and natural gas, both in the energy and transport sectors, Europe should simultaneously become autonomous and support the electrification and renewables development with a European battery ecosystem.

Creating a strong batteries industry will depend on long-term investments and a fit-for-purpose regulatory framework. About 800,000 new jobs are expected to be created before 2030 if Europe manages to increase its market share to 20%. The new Batteries Regulation needs to support this industrial dynamic and ensure a competitive and leading European value chain, able to decrease European dependency on imported batteries.

However, the intrinsic difficulty of enforcing several of the proposed design requirements in the Regulation is likely to create an uneven playing field, in which the EU industry will bear the burden of the regulatory constraints, while control of compliance with the sustainability rules for imported products is expected to be insufficient. “Enshrining too many constraints and regulatory hurdles in the Batteries Regulation within a too short timeline would risk setting back value chain efforts and planned investments and could ultimately endanger reaching the EU’s strategic resilience and energy security objectives”, concluded Chanson.

Thus, RECHARGE is calling on policymakers to thoroughly take into account the value chain’s recommendations for the inter-institutional negotiations under the Czech Presidency.

RECHARGE stresses the French Presidency’s role in the Batteries Regulation dossier

Brussels, 19.01.2022 - The French Presidency of the Council of the EU will today present its programme during the European Parliament plenary session. RECHARGE welcomes the Presidency’s programme, establishing that the “Presidency will speed up negotiations on the Batteries Regulation, which responds to major industrial challenges and has a high level of ambition in terms of reducing the carbon footprint of Europeans and the strategic autonomy of the EU”, and would like stress the Presidency’s crucial role in concluding the Council’s approach on the open dossier.

Following the important progress made during the Slovenia Presidency, France has established its steering note, as seen last week. The Presidency, aiming to finalise the Council's negotiations on the Battery Regulation during its term, identified a number of substantial elements: The debate has not been finalised in particular on hazardous substances (Art. 6), carbon footprint (Art. 7), recycled content (Art. 8), and supply chain due diligence policies (Art. 39). The French Presidency will now be pivotal in ensuring a robust and facts-backed Council position, which will ultimately ensure that measures deliver on advancing the decarbonisation and energy transition and that the European batteries value chain becomes a competitive global leader, able to set sustainability standards for the rest of the world. Moving forward, RECHARGE would like to reiterate some of our key policy calls:

• We call on policymakers to prioritise game-changing legislative measures such as due diligence and carbon intensity (see Articles 7, 39), compared to low-impact measures (see Articles 8, 10). If correctly implemented, both the carbon footprint and comprehensive due diligence across the supply chain (including manufacturing and recycling), have an unsurpassed steering potential to push European competitiveness based on sustainability and responsibility.
• We call on policymakers to avoid overlaps with existing, especially horizontal legislation, as is currently the case with the introduction of a REACH-like restriction mechanism (see Articles 6 and 71). Substances use (incl. the waste phase – see here) in articles, such as batteries, is already regulated by the horizontal REACH Regulation. Substances management at the workplace, including the manufacturing and recycling phase, is already regulated under OSH.
• A very cautious approach is necessary on recycled content, including science-based review clauses and safeguard measures against the risks connected to ex-ante specified minimum recycled content targets. RECHARGE has put forward its concern on the recycled content provisions on multiple occasions, especially with regards to the fact that these measures benefiting non-European value chain actors disproportionately, are thereby risking setting back European efforts to create a thriving battery ecosystem, and even jeopardising the transition to e-mobility should there be recycled raw material shortages. We would like to draw your attention to a recent RECHARGE study on the impact of the sustainability measures proposed in the Batteries Regulation and the feasibility of the implementation and control of these measures.

Following the thorough assessment of the Commission proposal for the planned Batteries Regulation (Progress Report) by the Portuguese Presidency, Slovenia will now be pivotal to ensuring a robust and facts-backed Council position. Moving forward, RECHARGE would like to reiterate some of our key policy calls:

• We call on policymakers to prioritize game-changing legislative measures such as due diligence and carbon intensity (see Articles 7, 39), compared to low-impact measures (see Articles 8, 10). If correctly implemented, both the carbon footprint and comprehensive due diligence across the value chain have an unsurpassed steering potential to push European competitiveness based on sustainability and responsibility.
• We call on policymakers to work towards essential policy areas instead of creating an environment of control and obligations. Batteries as well as the sectors they power are fast-paced and innovation-driven. A too stringent legislative framework risks stalling battery innovation and product development, eventually reducing the market reactiveness of European actors (see Articles 8, 11, 14, 59).
• We call on policymakers to ensure a timely yet technically robust implementation of the Batteries Regulation. Timelines shall be operationally feasible, and measures must be backed by a strong and complete assessment, covering environmental as well as social and economic aspects. Currently, this is not the case for some proposed measures (see Article 8).
• We call on policymakers to avoid overlaps with existing, especially horizontal legislation, as is currently the case with the introduction of a REACH-like restriction mechanism (see Articles 6 and 71).

European Battery Value Chain thanks Portuguese Council Presidency for work on Batteries Regulation

The Portuguese Presidency has set a remarkable pace at which the Council and Working Party on the Environment assessed the Commission proposal for a Batteries Regulation. The recently published Progress Report is proof of the need for a thorough and technically strong evaluation of the Commission measures, their effectiveness and long-term impact on the battery industry, related sectors such as mobility and renewable energy generation, and the European Union’s efforts towards decarbonization and industrial leadership.

Referencing the conclusions of the updated EU Industrial Strategy on the battery sector, the Batteries Regulation is not only a vital cornerstone of the European Green Deal but essential to the further development of a strategic European industry sector (still) in the making. RECHARGE has always supported the dual objective of the Batteries Regulation: (1) setting a new economic standard based on environmental and social sustainability, as well as (2) providing the European battery ecosystem with a strong legislative tool to fight unfair competition.

With this in mind, we welcome the Presidency’s decision to focus the Council’s work on Chapter II on Sustainability and Safety, and Chapter VII on End-of-Life Management of Batteries as they are key to the legislative framework - and to industry actors and end-users alike.

4th Revision of Carcinogens and Mutagens Directive and Occupational Exposure Limits for Nickel Compounds – EP EMPL Committee Report – Future Interinstitutional Negotiations

The Nickel Institute, together with RECHARGE, Catalyst Europe, CEEMET, CETS, EUROBAT, EUROFER, EUROMETAUX and the Frit Consortium and Inorganic Pigment Consortium prepared a joint letter on the ongoing legislative work to update the Carcinogens and Mutagens Directive (CMD4) and set EU binding Occupational Limit Values (BOELVs) for nickel compounds:

Occupational health and safety are a top priority for our sectors, and we welcomed the Commission’s proposal. We have been following the legislative process and we would like to share our perspective with you, in view of the upcoming interinstitutional negotiations.

We are concerned with compromise amendment N°7 adopted by the EP Employment (EMPL) Committee on 25 March. The third part of this amendment suggests adding a review clause (to Art. 1) indicating that, by January 2028, the Commission shall evaluate the feasibility of a further reduction of the BOELVs for nickel compounds and, where appropriate, present the necessary amendments by 2030. We do not agree with this approach for the following reasons:

1. Consistency with the ACSH consensual Opinion on nickel compounds:
   The Commission's proposal is based on the consensual agreement reached by governments and social partners in the tripartite Advisory Committee on Safety and Health (ACSH). The outcome of this thorough process, which took into account science, technical feasibility and socio-economic aspects, should be respected. Importantly, a review of the OELVs for nickel compounds was not recommended by the ACSH. On this point, the situation of benzene and nickel compounds differs.
2. Regulatory uncertainty for businesses:
   Adding a review clause for a possible revision / reduction of the BOEL values will create regulatory uncertainty and concerns in different European value chains and industries that rely on nickel compounds (e.g. metals, batteries, catalysts, pigments and frits, surface treatment). Furthermore, it would create regulatory uncertainty at a time when the EU and Member States want to encourage and promote investments in strategic “green technologies” in Europe (such as batteries production), for which the use of nickel compounds is essential.
3. Regulatory efficiency:
   Adding a review clause is not necessary because amendment 10 already requires that all the OELVs set under the Carcinogens and Mutagens Directive (CMD4) shall be kept under permanent scrutiny and revised, if necessary. Furthermore, a future reassessment would require additional time and resources by the Commission, diverting them from the objective, proposed by other EP amendments, of setting OELVs for additional carcinogenic substances for which there can be greater health benefits and a more urgent need.
4. The proposed limit values are robust:
   The proposed EU BOELVs are stringent and compliance will be challenging, particularly for some sectors and SMEs, as noted in the Impact Assessment Report and acknowledged by the ACSH. The proposed limits are a significant tightening compared to the OELVs currently in place in most countries in Europe. They are also significantly more stringent than existing legally binding limits in non-EU countries (e.g. Australia, Canada, China, Japan, South Korea, USA).

Conclusions:
Preparatory work to set the proposed EU OELVs for nickel compounds took many years of effort and resulted in limit values agreed upon by the tripartite ACSH. These OELVs should only be reconsidered when new scientific, economic or technical feasibility data warrants it, and not in a predefined and relatively short timeframe.

For all these reasons, we do not agree with the third part of amendment 7 and we support the Commission’s legislative proposal. We hope that a pragmatic solution can be found in the upcoming informal trialogue negotiations, to ensure the swift approval of the legislation, which is the interest of both workers and businesses.

RECHARGE Assessment of European Commission Proposal for Batteries Regulation 2020/353

The advanced rechargeable and lithium batteries value chain in Europe, as represented by RECHARGE, welcomes the European Commission's Batteries Regulation proposal 2020/353 (COD), in short Batteries Regulation, as the next step in delivering on the 2018 Strategic Action Plan on Batteries and, thus, working towards the common goal of setting the standard for sustainable, innovative and competitive batteries made in Europe.

Repealing the current batteries framework, the Batteries Regulation proposal better recognizes the strategic role of batteries for decarbonization, strategic autonomy and societal prosperity, and generally incorporates important updates as concerns today’s market structures. The latter refers to battery segments and battery chemistries likewise. At RECHARGE, we welcome that the Regulation has the clear objective of creating coherence with other EU policy areas and regulatory frameworks, particularly with those pieces of legislation that were implemented after the initial Batteries Directive.   

RECHARGE especially welcomes the inclusion of new key sustainability pillars as an important step forward:

1. The requirement to calculate and report the carbon footprint of electric vehicle batteries and certain rechargeable industrial batteries

2. The mandatory setup of supply chain due diligence programs on corporate social responsibility performance

3. The creation of an electronic battery passport for electric vehicle batteries and certain industrial batteries

4. The introduction of a green public procurement mechanism

Social due diligence and carbon intensity measures are paramount to the further development of the European battery sector as well as to the overarching climate-neutrality and industrial leadership objectives of the EU. At RECHARGE, we believe that article 7 and article 39 have the potential to strengthen batteries that have been designed and manufactured with the highest environmental and social conditions in place – provided that these requirements and their scope are correctly implemented.  

Also, RECHARGE wants to stress the importance of the modernization of the current batteries framework and transforming it into a European-wide regulation. This is a key step to ensure a high degree of predictability and clarity for economic operators. European investment as well as cutting-edge innovation and product development will depend on such level of certainty for many years to come.

However, despite relevant updates and innovations, the Batteries Regulation proposal does not fully meet its objective of creating a future-proof legislative framework. A high level of complexity and critical overlaps risk jeopardizing the effectiveness of the Commission proposal. It is against this background, that RECHARGE - as the leading group of technical experts - wishes to bring forward proposals for harmonization and simplification: 

Industry proposal to draft Batteries Regulation

ENSURE FEASIBLE TIMELINES: Given the strategic importance of the battery industry, a timely yet robust implementation of the new EU rules is crucial for this cornerstone legislation. As a general rule, the Batteries Regulation must include a grandfather clause to distinguish between new models of batteries that fall within the scope of the new requirements as created by the Batteries Regulation and products such as legacy spare parts or battery models introduced to the market before the entry into force of this Regulation. Also, certain deadlines between the proposed Batteries Regulation and the respective implementing acts pose a real challenge to compliance. This is especially the case for establishing the technically challenging calculation methodologies for the carbon footprint, the recycled content or for the new recycling efficiencies – all subject to an early declaration obligation. We recommend that all provisions directly or indirectly impacting the production process require a minimum 24-month transition phase for proper implementation at manufacturing line level.

STRENGTHEN ENFORCEMENT AND LEVEL PLAYING FIELD: To ensure the effectiveness of the European battery rules, RECHARGE recommends incorporating a dedicated paragraph on enforcement and the necessary resources required at Member State level to sufficiently execute enforcement measures for EU and imported products alike. Several articles are prone to become paper tigers without relevant enforcement. In addition, for the Batteries Regulation to successfully set the standard for environmentally and socially responsible batteries, all actors – inside or outside the European Union – must be subject to the same requirements. Therefore, third-party auditing bodies, as applicable under article 39 (3b) for example, that are based outside the European Union, shall ensure to apply the same standards - and potentially require an accreditation at EU level.

HOLD HIGH THE INDUSTRY’S EXTENSIVE SAFETY APPROACH: The draft Batteries Regulation introduces wording pertaining to removability, repair and remanufacturing that is of high concern to both the industry and consumer protection organizations. With the goal of upholding the industry’s comprehensive safety proposition, we, therefore, call upon European policymakers to refrain from any wording in the final Batteries Regulation that would encourage unqualified persons to remove, replace, repair or remanufacture a battery, and that contradicts existing safety standards. Ultimately, any battery – first or second use – should be subject to the same safety standards. 

HARMONIZE OVERLAPPING PROVISIONS WITH OTHER REGULATORY FRAMEWORKS: The Batteries Regulation has the clear objective of creating coherence with other regulatory frameworks. RECHARGE encourages EU policymakers to give priority to overarching, horizontal legislation, such as the existing chemicals management framework under REACH and OSH for example. The Batteries Regulation should not create another layer of complexity by introducing a REACH-like restriction mechanism for battery substances only. The assessment of substances used in batteries should remain subject to the horizontal chemicals management framework. In view of the opportunities created by the Chemicals Strategy for Sustainability, we call upon the European Commission to work towards a holistic chemicals management regime based on a robust risk management approach, including regulatory management option analysis (RMOA) and a socio-economic impact assessment.

HARMONIZE OVERLAPPING PROVISIONS WITHIN THE BATTERIES REGULATION: We welcome that the Batteries Regulation is an ambitious piece of legislation, with the potential to support an equally ambitious value chain in the transition to a sustainability-focused market structure. Certain provisions risk creating over-regulation and unnecessary overlaps, however. As an example, the Batteries Regulation proposal features extensive waste management actions, such as second life, recycling efficiency targets, material recovery targets and a recycled content obligation. While all battery chemistries are suitable for recycling and European research and innovation greatly focuses on driving recycling processes, circular economy measures should not overburden the industry, should take into consideration best available techniques not entailing excessive cost (BATNEEC) and must not create contradicting conditions. A successful battery waste management scheme reflects the fast-paced, innovative profile of batteries and battery-containing equipment. Flexible solutions are expected to create greater effectiveness than too stringent - or overlapping - measures that risk blocking the market. We also call for harmonized, streamlined and largely digitized information, labelling, declaration and auditing provisions 

REDUCE COMPLEXITY BY FOCUSING ON REAL-BENEFIT PROVISIONS: Batteries have been subject to a comprehensive regulatory framework since 2006. It is in this context, that RECHARGE promotes new legislative measures that bring a true benefit to the existing framework. The objective of the Batteries Regulation must be to work towards essential policy targets instead of creating an environment of control and obligations. Unfortunately, several provisions do not withstand the effectiveness test under real-world conditions. For example, in a fast-paced, innovative industry, performance and durability criteria are likely to stall product development and hamper the necessary flexibility to meet the specific needs of different products and applications. A number of design criteria would even contradict design requirements, such as lifetime obligations in areas where fast charge is needed. 

REDUCE COMPLEXITY FOR NICHE AND SMALL-SERIES BATTERIES: Certain measures create a disproportionate administrative and cost burden on niche or small-series batteries that are produced in only a few thousand units per year, designed to meet very specific application needs and often must be brought onto the market within weeks. Especially the scope of articles 7, 8, 59 and 65 – that were clearly established around the profile of mass-volume (EV) batteries - must be limited in view of the unique profile of these batteries. Similarly challenging is article 57 for several (niche) battery technologies. The recycling efficiency for lithium-based batteries and, respectively, certain material recovery targets are too technology-specific to be operationally achievable for all battery chemistries. The economic burden of complying with article 57 would basically drive such chemistries off the market.

Revision of Renewable Energy Directive - The Role of Batteries

Better recognizing battery storage services in a renewables-based electricity system

The revision of the Renewable Energy Directive (REDII) is a unique opportunity to take concrete actions towards climate-neutrality and to accelerate the green electrification of our society, including in mobility and buildings. The revision of REDII is particularly important to now incorporate key enabling technologies, such as battery energy storage, in a renewables-based electricity infrastructure.

• Battery storage systems are critical to ensuring a smooth energy production by balancing the grid in off-peak and low electricity production periods, providing a reliable and permanent interface between the production site and the electricity grid, and helping to regulate the voltage and frequency of the grid.
• They have become substantial to limiting curtailment of excess energy and, hence, limiting energy waste. 
• Further, renewables + storage has enabled a more decentralized and smarter electricity infrastructure that better enables the “utilization of local energy sources, increased local security of energy supply, shorter transport distances and reduced energy transmission losses”. 
• Batteries are a cost-effective storage solution. 

To foster the deployment of cost-efficient energy storage solutions, most notably of battery energy storage systems, and, thus, the accelerated deployment of renewable energy, a dedicated storage target should be implemented.

Generally, the Renewable Energy Directive needs to become more ambitious and prescriptive to ensure that the EU renewable energy objectives are reached: 

• We support increasing the overall Union target for renewable energy to more than 40% and introducing a target of at least 14% for renewable energy in transport by 2030. 
• Administrative bottlenecks, such as permits or alternating support schemes, need to be eliminated to drive the deployment of renewable energy. 
• In view of the important grid services delivered by battery energy storage systems, tender procedures should include clear storage criteria throughout the Member States.
• To achieve the climate-neutrality objective, public authorities have a critical role to play. Green procurement is, thus, of paramount importance. 
• RED II should foster self-consumption as well as renewable energy communities. 
• To achieve the 2050 climate-neutrality objective, the use of renewable energy in electricity, buildings, industry and transport needs to increase.
• An effective way to increase the share of renewables in the transport sector is to further support electric vehicles and to accelerate the development of a smart charging infrastructure. 
• Fostering digitalization and a smart electricity infrastructure will be paramount to the accelerated development of a decarbonized electricity system.

Better Regulation in Chemicals Management views: Commission paper on REACH Restriction and Occupational Safety and Health (OSH) OELVs

SMEUnited and the Cross-Industry Initiative for Better Regulation in Chemicals Management (CII), of which RECHARGE is member, welcome the European Commission’s initiative to clarify the interface between the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) and Occupational Safety and Health (OSH) policy frameworks. The members of SMEUnited and the CII are committed to protecting workers’ health and strictly implementing EU legislation in this respect. In line with the Council Conclusions on occupational safety and health of December 2019, the CII and SMEUnited consider it essential that the interface between OSH and REACH be clarified and that transparent procedures and criteria be used when selecting the most appropriate regulatory options. In line with the Council Conclusions, we welcome the DGs ENV-GROW’s thought-starter to promote a decision tree that would clarify the interface and optimise worker protection.

1. Do the Members of CARACAL agree with the proposed analysis and approach?

We see REACH restrictions and OSH directives as complementary tools. To achieve a fully balanced analysis of the contribution of the different legislations, including more accurate recognition of the benefits of OSH directives for worker safety, it is of utmost importance that further work on the paper involve OSH authorities on an equal footing with REACH authorities. We recall that OSH directives were established to define all important aspects of workplace risk management and are the correct legal route for establishing specific occupational exposure limits (OEL). However, we agree with the Commission that, to complement OSH (and OELVs), restrictions can be sensible measures to address risks that cannot be addressed under OSH and under specific circumstances. For example, while OSH (OELVs) may be sufficient to address risks of a substance in most workplaces, there may be individual uses where the RMOA finds that the substance cannot be used safely and that the ban of that specific use by means of a restriction is proportionate. Also, if there are workers outside the scope of OSH (self-employed), then it can be explored whether it is beneficial to side the OELV by a restriction for those other workers. This combination of OSH / OELVs with a restriction would avoid regulatory overlap and confusion. We are, however, concerned by the proposal to set restrictions that cover the same scope as an OELV would. We see restrictions establishing derived no-effect levels (DNELs) as a way to bypass OSH procedures, including the contributions of Social Partners. We, therefore, object to the suggestion that reference DNELs could serve as ‘use conditions’ in restrictions. Indeed, the introduction of ‘binding’ DNELs as an alternative to OELs via REACH restrictions undermines existing legal systems and is clearly at odds with REACH Article 1(4). In its explanatory memorandum to the second revision of the CMD, the Commission acknowledged: ‘REACH, on the other hand, is not intended to set occupational exposure limit values […].’

2. What criteria do the Members of CARACAL propose be used in evaluating which is the more appropriate risk management measure – EU OEL under OSH or restriction under REACH? Could this be further developed by the Restriction Task Force?

The Caracal paper suggests that the existence or not of an OEL for substance should be a relevant factor in deciding on the regulatory route to take. Whether an OELV already exists for a certain substance is however rather a matter of coincidence. It should not play a role in determining which regulatory route is the right one. Instead, a decision to select the most efficient regulatory risk management option should be taken as a result of a systematic and standardised regulatory management option analysis (RMOA). If the risk is limited to a workplace within the scope of OSH, and the RMOA finds that the best way to manage that risk is to set an exposure limit value, then an OELV should be set, irrespective of whether this means that an existing OELV needs to be updated or whether a new one needs to be developed. Only when measures are needed that cannot be adopted under the specific legislation for OSH, then a REACH Restriction could be a means of implementing this measure. As highlighted above, SMEUnited and the CII believe that an RMOA is the best instrument to enable authorities to clarify whether OSH or other risk management options need to be applied to address concerns in the workplace. We suggest that criteria be developed not only for making the appropriate choice between OSH/OELVs and Restrictions, but to also include criteria on when REACH Authorisation may or may not be the right risk management approach for the use of a substance. When dealing with worker safety, the risk assessment should involve not only REACH experts but also, on an equal footing, experts and Competent Authorities on Occupational Health and Safety (both at the European Commission level and Member State (MS) levels). Hence, SMEunited and the CII consider neither CARACAL nor the Restriction Task Force to be the right platform for developing criteria.

3. Should there be a specific forum for discussing and assessing the most appropriate risk management measure that coordinates all the actors responsible for OSH and REACH legislation?

SMEUnited and the CII contend that generic criteria should be developed, possibly as part of a guidance for RMOAs, to guide the choice of the risk management option. Given the topic of the interface between REACH and OSH, we consider a REACH Forum would not be appropriate to discuss those criteria. We propose instead that criteria for evaluating the best approach for worker protection are developed in the framework of a specific REACH-OSH multi-stakeholder forum. Those stakeholders should include both REACH and OSH experts, Competent Authorities and relevant institutions (DG EMPL, DG ENV, DG GROW, the tripartite Advisory Committee on Safety and Health at Work (ACSH) including specifically its Working Party on Chemicals). When it comes to the application of these criteria, in line with the suggestions of the Commission in the Chemicals Strategy for Sustainability, the responsible authorities should engage with each other.

4. Do the Members of CARACAL have additional suggestions/considerations?

SMEUnited and the CII support the view that the debate over the REACH/OSH interface should also address other practical questions. We believe that the thought-starter presented by DGs ENV-GROW could be broadened in scope so as to address these. For example, a decision-tree could include criteria to choose for which uses of a substance an OELV, a restriction or an Authorisation would be the most effective risk management option.

Apart from the clear economic benefits from developing the EU’s competitiveness in the sector, the growth in the value chain will also play a major role in decarbonising the European transport sector and help decentralise the provision of energy. RECHARGE welcomes Commission proposal for new legislative framework for batteries

Brussels, 10 December 2020 – “Today’s proposal for modernized EU rules for batteries represents the next milestone in delivering on the Strategic Action Plan on Batteries. It puts European policymakers in the unique position to now translate the EU’s vision for sustainable, innovative and competitive batteries “made in Europe” into a meaningful legislative framework that will close the gaps in existing legislation and can level the playing field with international actors”, welcomed Claude Chanson, RECHARGE General Manager in a first industry reaction the long-awaited Commission proposal for a new Batteries Regulation.

For years, RECHARGE has advocated a batteries framework capable of supporting the increasing role of batteries in a decarbonized economy and has called for adding requirements on the carbon footprint and social responsibility to the existing battery rules. Batteries were one of the first products to have been regulated on a lifecycle basis, from chemicals management and product safety to transport and recycling. “Due diligence and carbon intensity were clearly missing in this comprehensive framework so far, undermining the efforts of European actors”, explained Patrick de Metz, RECHARGE President. “The carbon footprint and due diligence measure now have the potential to not only prevent underperforming batteries from entering the EU market but to work on product-level on the EU’s climate-neutrality and sustainability objectives”.

Representing the battery industry of the future, RECHARGE cautions against the multitude of proposed measures, however. “In today’s proposal we see a high level of complexity and fear that this will translate into overregulating fast-paced, innovative industries such as batteries or electric mobility. Closing the gap with international competition will depend on long-term investments and a coherent regulatory framework”.

Since the creation of the European Battery Alliance in 2017, about a dozen Europe-based gigafactories have been announced. Overall investment in the European battery ecosystem reached EUR 60 billion last year and some 800,000 new jobs are expected to be created by 2023 alone. “We need the European framework to support this new industrial dynamic and provide for a comprehensive, timely and lean legislation”, stressed RECHARGE member and gigafactory start-up Automotive Cells Company (ACC – a joint venture between Total and Groupe PSA).

The Association welcomed the transformation of the current Batteries Directive into a Europe-wide regulation as a first step to create more clarity and predictability. RECHARGE emphasized the necessity to maintain such level of predictability in the further course of the legislative process.

The Batteries Industry of the Future: Ensuring a sustainable and competitive development

In this video presentation for the 2020 Future Battery Forum, which took place online from 10-11 December, RECHARGE's Pia Alina Lange outlines the pillars of a long-term sustainable, competitive and innovative battery value chain in Europe. Advanced rechargeable batteries, such as lithium-, or next-generation nickel-, zinc- and sodium-based battery technologies, are a strategic imperative for the industrial and social revolution towards a more empowered and sustainable society. The creation of the European Battery Alliance and the Commission's Strategic Action Plan on Batteries underpin the role of batteries for climate-neutrality and economic prosperity.

Especially, lithium-based batteries have been a main driver for the electrification of our mobility and energy storage infrastructures. Thanks to their unique characteristics, they are the leading battery chemistry in ITC and robots, too. To date, few other battery chemistries, also at prototype level, show similarly performing characteristics as lithium-based batteries when it comes to energy density and cycling ability. As an industry association, we expect that the lithium-based battery technology will remain the leading battery chemistry for the next two decades or so - at least. And also after that, they will continue to play a strategic role.

Continuous improvements in advanced materials design, application optimization and manufacturing technology are expected to further reduce cost and improve performance. So, we can continue to expect interesting developments and innovations in lithium-based battery technologies in the years to come. This includes the transition to solid-state electrolytes or new anode material developments for increased energy density.

Batteries Research & Innovation: Towards the creation of the Batteries European Partnership

Batteries European Partnership Association (BEPA) 

As member of the Shadow Group to the creation of the Batteries European Partnership Association, RECHARGE would like to invite you to join the central research and innovation hub for rechargeable batteries, battery materials and battery recycling technologies - to mention some of the relevant RD&I topics of BEPA. 

The Batteries European Partnership is an official candidate to Horizon Europe European partnerships. It is supported by four core associations (EMIRI, RECHARGE, EUCAR and EASE) and will gather - on the public side - the European Commission and - on the private side - all the interested stakeholders of the European battery community regrouped in a dedicated association: the Batteries European Partnership Association (BEPA).

The main missions of the BEPA will be:

• to provide recommendations for calls for proposals supported within the specific parts of the Horizon Europe Work Programmes related to batteries;
• to implement and regularly update the commonly agreed Strategic Research and Innovation Agenda (SRIA) for batteries;
• to support and oversee the portfolio of projects funded under the Partnership Work Programmes.
• but also to create and reinforce networks between the battery, RTOs, universities and other organisations, and ensure synergies with other European Partnerships and initiatives;
• and to support the development of EU regulations on battery standards, safety, and sustainability and actively promote and monitor innovation uptake in the market.

Association membership

Membership to BEPA is open to legal entities with relevant activities in R&D, demonstration, industrialisation, production, commercialisation or deployment of the technologies and services within the scope of the Partnership, sharing and supporting the objectives of the Partnership, and performing activities in the European Union (or countries associated to the Horizon Europe Programme).

The Membership will be subject to payment of an annual membership fee, which varies depending on the membership category.

New EU Batteries Rules: Delivering on the Strategic Action Plan on Batteries

The publication of the Commission’s proposal for a new EU batteries legislation on December 9, is the next step in delivering on the European Strategic Action Plan on Batteries. A major novelty is the shift from a Member State-based Directive (as the Batteries Directive 2006/66/EC is) to a Europe-wide Batteries Regulation. Also new shall be additional requirements for social responsibility and environmental sustainability. In total, fourteen new measures are expected to form the basis for the proposal of a new batteries regulation in Europe. 

An opportunity for better regulation

While batteries have already been regulated on a lifecycle basis since 2006 - from chemicals management and product safety, to transport and recycling -, the modernization of the
EU batteries rules now allows policymakers to close important gaps in the existing Batteries Directive and to create more coherence with other EU policy ambitions, too. 

For years, RECHARGE has advocated a batteries framework capable of supporting the increasing role of batteries in a climate-neutral society and has called for an effective rescoping of the existing battery directive. Due diligence and carbon intensity were missing in the comprehensive framework regulating batteries as well as important definitions around the topics of equivalent conditions for recycling outside of the EU or end-of-waste to enable second life options for spent batteries. 

These measures – and their legislative process – are now being discussed at Member State level (EU Council) and in the European Parliament. As the industry voice for the advanced rechargeable and lithium batteries value chain in Europe, RECHARGE supports the legislative debate with expert knowhow and industry data.

Our policy recommendations include: 

• Carbon footprint content as a pivotal environmental and quality performance indicator
• Mandatory requirements for human, social, and labor rights along the value chain
• A digital battery passport for comprehensive tracing of materials
• Effective, net-value circular economy strategy thanks to high-impact materials recycling and a recycling concept that can meet the innovative, fast-paced profile of batteries
• Safety and EPR measures to facilitate repair and refurbishment for second life batteries
• Smart changes to the existing classification system, with sub-categories for small industrial
  batteries and EV batteries
• Improved collection reality with increased user sensibilization, available for collection

Modernising EU Batteries Directive - The legislative measures to a new Batteries Regulation

By mid-November, the European Commission is going to publish its legislative proposal for a revised batteries directive. A major novelty will be the shift from Directive to Regulation. Also new will be additional requirements for social responsibility and sustainability. In total, fourteen new measures are expected to form the basis for the new batteries regulation in Europe.

In the first issue of “The Battery Value Chain Explains”, RECHARGE – the industry association for advanced rechargeable and lithium batteries in Europe – wishes to explain the impacts of the planned rules for batteries on the industry, and, where applicable, on the environment and users. Step by step, measure by measure:

1. Level Playing Field: In line with the amibitions of the European Battery Alliance, the legislation should support a prosperous European battery industry that will substantially contribute to the
   achievement of the emission reduction targets while being capable of competing against strong, existing markets outside of the EU on a fair basis. Measures must, hence, apply to EU as well as
   imported batteries, and be meaningful and effective.
2. Lean Legislation: Industry, long-term investments and cutting-edge innovations depend on a legislative framework that is capable of providing predictability and flexibility likewise. The coherence between the different legislative instruments regulating batteries and their components should be taken into account when modernizing the batteries legislation. Overlaps, as well as
   over-regulation, must be avoided. Measures should be balanced and based on a sound, scientific argumentation.
3. Value Chain Approach: For battery-enabled decarbonization and innovations to succeed, it is essential to ensure that the battery industry in and outside of Europe is socially and  environmentally sustainable throughout its entire value chain. All steps, from materials extraction to manufacturing and recycling should ensure human, social, and labor rights and contribute to
   the CO2 reduction objectives. A sustainable and internationally competitive industry cannot be provided otherwise.

A strong supporter of the European sustainability agenda, RECHARGE participates with scientific evidence and industry knowledge in the respective institutional work programs to help establish a regulatory framework that will enable European actors to execute on the technological, environmental and social leadership ambitions of the Strategic Action Plan on Batteries.

Joint Industry Paper Integrated Batteries in the Revision of the EU Battery Directive

• Applications of integrated batteries Integrating batteries has long been a design strategy to leverage innovations and functionalities that would otherwise not be available. We define “integrated batteries” as embedded in the device by design, not removable without tools. Rechargeable batteries are integrated across a great many product categories, some of them are shown as an example in Figure 1. When rechargeable batteries are not integrated, there is a functional reason. E-bikes, power tools or accessories for electronic products all allow for battery exchange in the middle of a work flow. When batteries are integrated, there are good reasons for that, too: across our sectors, we see smartphones, notebooks, smartwatches, gardening tools, toothbrushes, shavers, toys and other products integrate batteries to increase water resistance or dust protection, and hence not only improve product performance but also battery lifetime. Cars, e-mobility applications and electronic products integrate batteries for safety and reliability reasons to reduce vibration and exposure to external shocks. Cars also benefit from reduced weight and reduced CO2 emissions linked to this design strategy. Across most of our sectors, products with integrated batteries can benefit from thinner or smaller form factors, or extra space that becomes available for other components, driving both cost and material efficiency. In some cases, such as medical devices, applications are used in extreme environments where integrated packaging of battery and device are the only way to ensure protection from moisture ingress over long periods of time (e.g. 10 years). An important reason for integration in the case of lithium-based rechargeable batteries is consumer safety. The integration of a battery ensures voltage, current and temperature limits. Integrated batteries are the norm for many applications with rechargeable batteries. Requiring a different design by regulation would impact environmental performance, customer expectations, lifetime, functionality, cost and material efficiency while forcing device manufacturers across many product groups into re-design.
• Innovation outlook and integrated batteries In addition, there are exciting battery innovations on the horizon. We caution against changes to Art. 11 of the Batteries Directive or other eco-design measures, which could hamper the deployment of those innovations. Bendable, flexible batteries are predicted to come to mass production in the next 2-4 years, and thin film (solid state) batteries are forecasted to see a market growth by 2025 to $400-600 million. These batteries are intended to be used in smart cards, wearables, flexible displays, medical and cosmetically transdermal patches, IoT, sensors, smart packaging, pacemakers, hearing aids, capsule endoscopes, military and e-textile applications, as well as automotive and large ESS, just to mention some. Battery innovations like these can be environmentally benign (biocompatible), can have high temperature stability, low self-discharge and high power density. The most exciting battery innovations on the horizon will allow for further miniaturization of devices and applications, and incorporation of smaller batteries, thus, positively impacting the raw material use for these products and user-friendliness. Any regulation and removability requirements need to be future-proof and should provide for appropriate exemptions.
• Removability and repair The EU is currently considering options to introduce a European Right to Repair. We would like to point out that recent revisions of landmark legislations have already strengthened the right of consumers to have easy access to repair. The new Waste Framework Directive (2018/851) imposes access to spare parts and repair instructions under certain boundary conditions (safety, quality, IPR) in its Art 9(1). The new Sales of Goods Directive (2019/771) continues to include the right to have a faulty product repaired or replaced free of charge, or to obtain a refund or a price and strengthen consumer rights in this regard with durability as a conformity requirement. Already today, every product with integrated batteries on the market has a repair service during the legally mandated warranty period. In future policy discussions, we believe that the European Right to Repair should mean making sure that the consumer has access to a high quality, safe and secure repair option in all cases (in- and out-of-warranty). Consumers have a rightful expectation of a repair remedy of quality, safety and security. However, this does not mean that repairs can be carried out safely and successfully by consumers themselves, nor that they should in all cases have the right or ability to do so themselves. Especially for high-complexity devices (ranging from electronics to cars), trained and qualified personnel can guarantee the highest level of safety, whereas consumer-led repairs could impact the integrity of the repaired device, and such unintended outcomes should be reflected in any future regulation. Battery safety is obtained by a combination of mechanical, electrical and electronic protections and part of it is achieved by the integration of the battery itself. The liability for product safety in case for repair or replacement can generally be best ensured by a qualified professional. There is strong justification for focusing right to repair on the availability of repair options that ensure consumers have access to high quality, safe and secure repairs, instead of only on a consumer-led repair. One such example are established manufacturer-associated repair networks, which provide consumers with convenient access to such repair options. Such authorised service providers or affiliated networks are optimised for efficiency, and therefore minimise environmental impacts beyond what would be possible via consumer-led repair models. Conservative estimates put the number of repair and after-sales jobs associated with manufacturer after-sales/repair providers at over 240,000 globally, providing high-quality service in a circular economy. They also ensure proper end-of-life recycling options. Any policy, whether focused on battery replaceability by design, consumer policy or repair operators should consider the impact on the existing vast repair network of professionals. RECHARGE calls for increased renewable energy targets (RED II) to further reduce GHG emissions in transport, electricity and building sectors

1. Thanks to optimization efforts in manufacturing, economies of scale, advancements in materials efficiency and an uptake of electrified mobility, the cost for battery storage has substantially decreased in the last decade, leading to cost parity for PV + storage with traditional energy sources. Further cost reductions are to come from material and battery design innovation and new (or emerging) battery chemistries.
2. Thanks to batteries’ balancing services to the grid and their suitability for micro/decentralized grids, investments in the transmission and distribution system are expected to be lower.

• Electrification of transport, heating & cooling: A cost-effective and flexible electricity system is indeed important, especially to further encourage renewable energy use also in other areas than electricity generation. RECHARGE supports increased electrification of passenger and cargo transport based on a high share of renewable energy for the battery manufacturing and charging phase, to (a) reduce GHG emissions in the transport sector and (b) unlock the potential of the interconnection abilities of renewables + storage for other sectors such as buildings and industry. We believe that planned measures in the renewable energy (and other energy-related) legislation should further encourage innovative models such as sector coupling and vehicle-to-grid.
• Economic value: We agree with the Commission’s assessment that increased renewable energy targets will also have a positive impact on economic growth and investments by creating quality jobs and reducing dependence on non-European energy sources. The battery storage industry alone is expected to generate €210 billion new GDP and create some 1 million jobs by 2022.
• Incentivizing prosumers with storage systems: We welcome that in the current Renewable Energy Directive, especially article 21 § 2(b) , attention had been given to taxation and charging questions related to self-consumption in renewable energy installations with storage systems. Based on Directive (EU) 2019/944, article 15 § 5, RECHARGE encourages extended provisions for both self-consumption and prosumers with the aim of further incentivizing utility-scale and behind-the-meter storage solutions. Also, clarification is required regarding priority access for renewable energy that is fed into the grid, coming from either primary production or stored renewable energy (see Directive (EU) 2019/944, article 15 § 5(d).
• Clarification of guarantees of origin for energy from renewable sources: In relation to our work for the PEFCR (Product Environmental Footprint Category Rules) for rechargeable batteries, RECHARGE calls for additional clarification regarding guarantees of origin for energy from renewable sources (article 19) and the offsetting mechanisms applied. Guarantees of Origin must be a fair mechanism to reward companies using green energy while further incentivizing Member States to develop their renewables-based electricity infrastructure.

Council calls for a clarification of the REACH-OSH Interface

• The CII considers the clarification of the REACH-OSH interface essential to the goal of protecting workers while maintaining the competitiveness of the EU’s industries. The CII, therefore, supports the Council’s conclusions and recommends the following: developing Guidance on Risk Management Option Analyses (RMOAs) that would provide criteria for selecting the most appropriate risk management option and that would, in particular, clarify in which cases OELs are preferred to other risk management options.
• developing the long-planned Common Understanding Paper on REACH and OSH. This paper should be developed under the responsibility not only of DG Environment and DG Growth (for REACH) but also of DG Employment (for OSH). It should take into account input from Member States and stakeholders.
